中國錢塘法院於 3月 23 日釋出涉及美金穩定幣 USDT 的民事借貸糾紛案件審理，法院認定原告主張被告需返還借款與連帶利息損失的訴求不予支持，判決雙方借貸關係不成立，並駁回原告訴訟請求。
中國錢塘法院近期釋出關於 USDT 的民事借貸糾紛指，加密貨幣相關業務屬於非法金融活動，裁決雙方借貸關係不成立，駁回原告訴訟請求。
法官也對此指出，除了加密貨幣以外，先前審理的礦機案本身也不受法律保護，所有損失皆需由當事人自行承擔。

中國錢塘法院近期釋出關於 USDT 的民事借貸糾紛指，加密貨幣相關業務屬於非法金融活動，裁決雙方借貸關係不成立，駁回原告訴訟請求。
據案件原告表示，2 位被告於去年 6 月因為需要資金周轉因此提出借款需求，原告便以加密貨幣 (USDT) 支付。被告也擬出了一份「借據」並載明借得人民幣 40 萬元，承諾將於 2 個月後返還。
因透過 USDT 支付 所以無法向法院出示借出 40 萬元人民幣
不過，被告在到期後並未依約還款，所以原告一狀告上法院要求索賠借出的人民幣 40 萬元與相應利息，怎料，原告因為是透過 USDT 支付給被告，所以無法向法院出示借據上實際匯出的 40 萬元人民幣明細，甚至還被被告反咬，指稱原告根本並未按照借據約定交付 40 萬元人民幣。
法官還提醒，除了加密貨幣以外，法院近期審理的另一起涉及加密貨幣的買賣合約糾紛案件中，原告訴稱透過加密貨幣向某科技公司購買「礦機」，但被告卻未按約交付「礦機」，使原告受經濟損失，訴求被告返還貨款。
但由於原告透過加密貨幣購買相關衍生品（礦機）的行為本身就不受法律保護，因此法院最終判決駁回了原告的訴訟請求。最後法官表示，任何生產經營活動皆需在國家相關法律規定和產業政策允許的範圍下進行，作為市場經濟的參與者，應自覺防範加密貨幣交易風險，維護市場秩序與社會公共利益。
身為公職人員更應以身作則，切勿參與加密貨幣挖礦及炒作交易，更不能使用單位場所、設備、電源、流量等參與虛擬貨幣「挖礦」等謀取私利行為。
