FTX 申請破產後，後續還有許多蝴蝶效應，包括 SBF 極力推動的《數位商品消費者保護法》(下稱 DCCPA)。同樣也在推動 DCCPA 的 CFTC 主席 Rostin Behnam 首次在 FTX 倒下後出席參議院的聽證會，也是唯一的證人。
Rostin Behnam 表示，過去幾週，加密市場以眾人最不願意看到的結局，暴露加密貨幣嚴重缺乏監管。雖然 CFTC 有很多工具可以挽救受騙用戶，但過程漫長又艱鉅，有時也無法追回全部資金。全面監管可讓我們在詐騙發生之前就透過框架保護用戶。
他呼籲應繼續推動 DCCPA 的立法，作為保護投資人、防止加密市場崩潰的方式：
「九月的時候，我在你們面前表達強烈支持 DCCPA。這個法案代表了 CFTC 同仁的專業知識，加上和 SEC 一些成員的密切合作，建立了類似於 CFTC 當前對於衍生性金融商品的監管框架。」
就算禁止，風險還是會回到美國
Rostin Behnam 認為，就算美國政府全面禁止加密產業，將產業推向海外市場，並在海外監管，最後加密市場也會透過散戶和機構投資人，將風險重新帶回美國。
Rostin Behnam 以 FTX 作為反面教材，表示如果國會能以加密市場為核心，建立完整的監管框架，像是審計財務揭露、資本適足率、隔離用戶資金這類的準則，這可有效防止加密公司挪用用戶資金。
同時監管的確立也會讓更多的加密公司轉移至美國。
他強調， LedgerX 在 CFTC 的監管下是少數沒有申請破產的 FTX 子公司，以此證明 CFTC 監管的必要性。
「如果 CFTC 沒有獲得國會授權監管，光靠當前的聯邦監管框架會有漏洞存在。DCCPA 確實解決的這些問題，會禁止 FTX 挪用用戶資金。」
兩大監管機構需要合作
儘管 CFTC 不斷強調其監管加密市場的正當性，但 SEC 主席 Gary Gensler 先前就表示過除比特幣外，幾乎所有加密貨幣都會被歸類在證券範圍。
據 The Block 的報導，Gary Gensler 表示 DCCPA 可能會導致 SEC 的監管業務變得更複雜。
先前鏈新聞也報導過 SEC 對於加密監管的自身立場，即：如果有某個人或某個事件針對大眾籌集資金，而發起人、贊助商、主事團體的所作所為讓大眾預期著獲利，這種情況必須歸類在證券法內。
不過這並不表示 CFTC 和 SEC 不會合作。事實上雙方皆表示願意攜手合作，差別在於如何將各自的準則帶入監管框架保護用戶。
