香港證監會一向對加密貨幣態度保守，多間加密貨幣交易所未獲發牌或註冊，未能在港進行受規管的活動。區塊鏈遊戲公司 Animoca 總裁 Evan Auyang 批評，港府對加密貨幣一竅不通。

 

港府對加密貨幣的態度

香港目前對加密貨幣監管制度是傾向加密貨幣相關服務的供應商需申請牌照許可。並只能向專業投資者提供服務。專業投資者的定義是投資組合規模超過 800 萬港元（100 萬美元）的個人或總資產超過 500 萬美元的公司，譬如大型交易所FTX。

而受證監會監管的基金經理最多可以將總資產價值的 10% 投資於加密貨幣，如果他們希望進行更多投資，可以申請特殊許可。

加密貨幣平台牌照

香港唯一一間獲頒牌照的加密貨幣交易所 OSL Digital Securities，在 2020 年 12 月 15 日已獲香港證券及期貨監察委員會（香港證監會）頒發牌照（第 1 類（證券交易）和第 7 類（提供自動化交易服務）受規管活動）。

關於 OSL 平台及 BC 集團

未有頒發任何牌照

已獲政府頒發牌照的加密貨幣交易所，無疑大力增加平台公信力度。而香港證監會早在 2018 年已公布香港加密貨幣平台可申請牌照。但截至目前為止只有 OSL 為唯一一間本地持牌平台。

近年，每當有全球知名平台打入香港，港府亦從未頒發任何牌照，如 BitMex，Huobi 火幣，FTX，幣安等。此等交易所，資金管理已在全球規模過500億美金。

港府態度強硬

香港證監會一直拒任何交易平台於千里，如近期的幣安，香港證監會更一度全面封殺幣安交易所，公開指責幣安未獲發牌或註冊在港進行受規管的活動。

加密貨幣平台幣安（Binance）近期因提供股票代幣交易服務，而接連被各國監管機構封殺。香港證監會今日亦發公告，強調股票代幣在香港相當可能構成《證券及期貨條例》定義下的「證券」，故股票代幣屬於證監會的監管職權範圍，而幣安集團旗下的任何實體均未獲得發牌或註冊以在香港進行「受規管活動」。

Animoca 總裁 Evan Auyang 稱：「區塊鏈改變世界是必然的，香港想不想成為這部份的領先者，很取決於香港政府的態度。」

政府似乎未有大力投放資源、推廣、技術、合規範層面在加密貨幣、NFT。而證監會旗下唯一合法的持牌平台 OSL ，需要專業投資者才可參與。除了 OSL 之外，至今無一海外平台可以完全打入香港市場。
